Motorcycle Accident Attorney for Melbourne, Orlando, and Central Florida – State Motorcycle Laws

It takes a different set of skills to ride a motorcycle than it takes to drive a car. Every rider should have the appropriate training and skills so they can avoid a motorcycle accident. However, riders should also be aware of the regulations for riding a motorcycle in the state of Florida, or whatever state they are riding in. This will ensure that motorcyclists know their rights and are not taken advantage of if they are ever involved in a motorcycle accident. We have listed some of the most important motorcycle regulations below, and we encourage every person who rides a motorcycle to educate themselves. If a rider is involved in a crash, however, it is vital that the victim seek the guidance and advice of a motorcycle accident attorney. Serving Central Florida, including Orlando and Melbourne, Frank Eidson can help motorcycle accident victims and their families obtain the compensation they need and deserve.

Florida Motorcycle Laws

Motorcycle and automobile laws differ from state to state, and ignorance of these regulations could have harmful consequences. We have listed some of the most important Florida motorcycle laws below.

Helmet Requirements

Insurance Coverage

PIP Insurance

Lane Splitting

Bike Specifications

Helmet Requirements

If a rider is over 21-years-old and has at least $10,000 in medical insurance coverage, a helmet is not required. Florida is one of the only states in the United States in which helmets are not required, so riders venturing outside state lines must pay attention. Some form of “eye protection device” (Florida Statute 316.211) worn over the eyes is required by law, however.

Insurance Coverage

Under Florida’s Financial Responsibility (FR) law, riders are strongly encouraged to carry at least $10,000 in property damage and body injury liability insurance coverage. Should a rider without insurance get into a motorcycle accident, or get a DUI, the state may suspend the person’s license, take away the motorcycle tags and registration, and require three years of high-risk mandatory liability insurance coverage. In essence, insurance is not explicitly required, but if something happens the consequences will be severe. The world of insurance claims is often confusing. To sort through it, many victims hire a motorcycle accident attorney. Injured riders from Orlando, Melbourne, and all of Central Florida can turn to our practice to make sure they receive fair treatment from the insurance companies.

PIP Insurance

Florida’s controversial Personal Injury Protection (PIP) auto insurance law, which guarantees coverage regardless of the cause and circumstance of the auto accident, does not apply to motorcycles.

Lane Splitting

Florida motorcyclists are not allowed to share lanes with cars or ride between lanes of traffic, as they are in some states, but two motorcycles are allowed to ride side-by-side in the same lane.

Bike Specifications

Florida law prohibits bikes made after 1979 from being louder than 78 decibels when going under 35 miles per hour, and from being louder than 82 decibels when traveling over 35 mph. For motorcycles made before 1979, the maximum noise levels are 82 and 86 decibels, respectively. Also, it is illegal to modify the motorcycle to be louder than it was when manufactured. Turn signals are not required, but the bike must have at least one mirror on it. Finally, the handlebars cannot be higher than the rider’s shoulders when he or she is seated on the motorcycle.
